These terms apply to consumer purchases made through www.rustybarrel.co.uk. Trade purchases may be subject to separate terms.

Placing an order

When you place an order, you are offering to purchase the products in your basket.

You will receive an email acknowledging the order. This acknowledgement does not necessarily mean that the order has been accepted. We accept the order when we send confirmation that it has been dispatched.

If we cannot accept an order, we will tell you and refund any payment taken. Reasons may include:

• the product being unavailable;
• payment not being authorised;
• an error in the price or description;
• suspected fraud or misuse; or
• a delivery restriction affecting the address supplied.

Please check the order information carefully before completing checkout.

Products and descriptions

We take reasonable care to ensure that product descriptions, photographs, dimensions and prices are accurate.

Colours and finishes may appear slightly different depending on the screen used to view them. Hand-finished and hand-plated products may also have natural variations; these are part of the individual character of the product and are not normally faults.

Packaging may occasionally differ from photographs without affecting the product itself.

Prices and payment

Prices are shown in pounds sterling and include VAT where applicable.

Delivery charges, if any, are shown before the order is completed.

We may correct an obvious pricing or description error. If an error affects an order already placed, we will contact you before dispatch and give you the choice of confirming the order at the correct price or cancelling it for a full refund.

Payment must be authorised before an order is dispatched.

Discount codes and promotional offers may have their own conditions and cannot be exchanged for cash.

Delivery

Available delivery services, estimated times and charges are shown at checkout.

Free delivery is available on eligible orders of £10 or more to UK mainland addresses, excluding the Highlands and Islands.

An expected next-working-day service may be available for eligible orders placed before 2pm on a working weekday. Weekends and bank holidays are excluded, and next-working-day delivery is an estimate rather than a guarantee.

We normally use Royal Mail but may use an alternative provider when reasonably necessary, including during disruption or peak periods.

We will deliver within the period agreed at checkout or, where no period is agreed, within 30 days unless circumstances outside our reasonable control prevent this.

If a significant delay occurs, contact us. Where the law gives you the right to cancel because of a delay, we will refund the affected undelivered products.

Responsibility for the products passes to you when they are delivered to the address, neighbour or safe place selected or authorised for the delivery.

Cancellations, returns and refunds

Our 100-day free returns policy and your statutory cancellation rights are explained in our Refund Policy.

For most online purchases, you may tell us that you wish to cancel within 14 days of receiving the products and then have a further 14 days to return them.

The voluntary 100-day policy does not reduce or replace your statutory rights.

Faulty products and warranty

Products must be as described, fit for purpose and of satisfactory quality.

If a product is faulty, damaged or incorrectly supplied, contact support@rustybarrel.co.uk so that we can arrange an appropriate repair, replacement or refund.

Rusty Barrel cocktail-making sets are also covered by our voluntary two-year replacement warranty. This warranty is provided in addition to your statutory rights and does not restrict them.

Our responsibility to you

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory consumer rights.

We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable, or for business losses where products were purchased wholly or mainly for commercial purposes.

Website use and intellectual property

The content of this website—including text, photographs, logos, graphics and product designs—is owned by or licensed to Urban Factory Limited and is protected by intellectual-property law.

You may use the website for personal shopping and information. You must not copy, reproduce, resell or commercially exploit its content without permission.

You must not misuse the website, attempt unauthorised access, introduce malicious code or interfere with its operation.

Personal information

We use personal information as described in our Privacy Policy.

Third-party links

The website may contain links to services operated by other organisations. We are not responsible for their websites, content or privacy practices.

Changes to these terms

We may update these terms from time to time. The terms that apply to an order are those in force when the order is placed.

Any change will apply prospectively and will not remove rights that have already arisen under an existing order.

If part of these terms is invalid

If a court or relevant authority decides that part of these terms is unlawful or unenforceable, the remaining terms will continue to apply.

Governing law

These terms are governed by the law of England and Wales.

If you live in Scotland or Northern Ireland, you also retain any protections provided by the law of the country in which you live and may bring proceedings in your local courts.
